At 1:00 p.m., following a luncheon period, Chairman Craig Jennings, County

Commissioner from Preston County, opened the business meeting.

Mr. Jennings stated that in the past, Gary Howell has been providing the secretary duties of the Association. However, it has been agreed by members that the elected Chairperson would be responsible to provide a secretary. An account has been set up and each county will contribute $500. to assist with expenses.

Mr. Jennings introduced Dianna Hartman, Administrative Secretary to the Preston County Commission, who is today recording the minutes.

It was appropriately moved and seconded to approve the minutes of the May 20, 2009 meeting.

There was no correspondence for consideration.

Under Old Business, Mr. Harsh advised that nothing has yet been done on the intersection of WV24/US50, in the Aurora area. He said he believes the “logical” thing before any repaving is done would be to upgrade. He said he would like to see someone from the state department meet with locals and perhaps hold a public hearing. He believes that project has been over engineered and over cost. He also has questions about the rights of ways on 24/50. He said in traveling to Hampshire County today, he has seen costly projects currently in progress and he believes the 24/50 project would be much simpler and cheaper to correct.

Cate Johnson stated that Congressman Mollohan’s Office will also contact the state concerning this project.

Craig Jennings will also have the Preston County Commission to send another letter to the appropriate officials.

In reference to the Little Cacapon Road, while the District Engineer has advised that money has been appropriated for that project, nothing seems to be happening at this time. The project was to be done last year.

Under New Business, Mr. Jennings asked for discussion of 2010 goals. It is his wish to get County Commissions on board with the Association and to have by-laws enacted this year.

It is believed that with the completion of Corridor H, there should be money available for some of the feeder roads.

Mr. Harsh believes that Route 219 leading into Thomas should also be looked at.

Mr. Howell stated that he would like a goal of 2010 to be to continue 4-laning some areas, particularly from Clarksburg to 81. He believes that some existing roads could be 4-laned. He said many priorities were listed some years ago and he believes the Association should review that list.

Mr. Parker said he believes communication with the federals is quite important.

Gary Howell said it is important to get National Guard units involved for emergency evacuations and national security. These plans should be implemented.

He believes it would be beneficial if both state and federal delegates could attend meetings.

There was discussion on what dates and times would be best for Association meetings. Some suggested that perhaps a night meeting should be considered.

Mr. Spiggle moved, seconded by Mr. Harsh to hold Route US 50 Association meetings the first Tuesday of odd months, with the time for the next meeting to be determined by Chairman Jennings, after consulting with Brian Carr and Bill Woods as to their availability. All were in favor. Motion carried.

Mr. Jennings is going to work hard to get Taylor County more involved.

There were no specific regional issues.

Under citizens concerns, Mr. Harsh extended special recognition to Mr. Spiggle and Mr. Howell for bringing this group together for the improvement of all. They deserve a special thanks. All were in agreement.

Gary Howell announced that Mineral County will be the host county for the next meeting , tentatively scheduled for November 3, with the location to be announced.

The meeting in Grant County is scheduled for January 5.

There being no further comments or business, Chairman Jennings declared the meeting adjourned at 2:10 p.m.

Dear Route 50 Associations Members,

This letter is concerning the designation of U.S. Route 50 as a Scenic Byway through Hampshire County. After serious thought and consideration, the County Commission of Hampshire County has decided to not pursue this issue; however, we do offer our support to any other member of the Association that wishes to designate their portions of the highway as a Scenic Byway. Our major concerns over this issue arise from the U.S. Route 50 being Hampshire County's major access road, and the designation may inhibit commercial development due to signage regulation imposed with the designation. We are also in pursuit of numerous upgrades along the Hampshire County section of Route 50, of which a byway designation would in fact bring about conflict.

We again offer our support of other counties; however we must decline in the joint pursuit to designate the entire stretch of U.S. Route 50 as a Scenic Byway, as we wish Hampshire County to remain un-designated.

Dear Senator Byrd:

We are writing to urge your support of the appropriations request from US Senator Ben Cardin(D-MD) for the US 220 portion of the proposed North-South Appalachian Corridor in West Virginia and Maryland. Additionally, WVDOT needs approximately $ 2.5 million for its portion of these bi-state preliminary engineering studies required by NEPA.

In a cooperative four state (PA, MD, WV, VA) feasibility study it was forecast that a relocated US 220 four(4) lane divided highway between Interstate 68 in Cumberland, Maryland and Corridor H in West Virginia would generate a 19% increase in permanent jobs or over 8,000 from an existing job base of 43,350 within West Virginia and Maryland. An additional approximately 2,500 jobs would be generated when US Route 219 from I-68 in Maryland to the Pennsylvania Turnpike (I-70/76) in Somerset, PA is completed as the northern leg of the North-South Appalachian Corridor.

That is huge for the Potomac Highlands region of our State and your support is critical in this effort.

Introductions: Dave Price, Preston County Commissioner welcomed everyone to the meeting stating, Wayne Spiggle then opened the meeting by requesting each county introduce themselves as a group. He made special recognition of former Delegate Robert Harman from Keyser.

Old Business: David Moe provided a copy of a funding request letter for the North/South US 220 Corridor Tier 1 study. The letter can be found on the US 50 Association website. David went on to say that the Tier 1 study was originally to start in 03/04 and take 18 to 24 months. The completion date was pushed back to 2007 and that has still not been met.

The intersection of US 50 and WV 24 was discussed and Brian Carr of WVDOH said a speed study should start in June when weather will allow the installation of traffic study devices. After the study, the traffic engineering division will make a recommendation which may require a public meeting if changes are indicated. Brian Carr acknowledged that the intersection needs to be redesigned, but because of funding restraints and priorities that it precludes it at this time. Larry Weaver indicated that the grade of the intersection makes the project more expensive than other improvement projects.

David Moe spoke about the Corridor O project and stated that it may not go anywhere. Chris Strovel of Congresswoman Capito’s office stated the Congresswoman believes that the extension of Corridor O could reduce funding for other ADHS corridors in the state. Cate Johnson of Congressman Mollohan’s office indicated that no co-sponsors had signed on to H.R. 1489 the Corridor O extension bill.

Congresswoman Capito did introduce a request for ten million dollars in improvements to US 50 in Hampshire County to improve safety and traffic flow.

Wayne Spiggle requested the group consider requesting Scenic Byway status for US 50 over the length from the Virginia state line to Interstate 79. Robert Harman objected stating that Scenic Byway’s are anti-business and they stop signage along the route. Wayne Spiggle disagreed. He stated the Byway allows access to grants to celebrate the highway and that is pro-business. He stated that advertising is not affected because it is only eliminated in the areas that have intrinsic value. Gary Howell disagreed asking if the area of the Saddle Mountain overlook was considered an area with intrinsic value and it was stated so. Howell went on to explain that that also happened to be the intersection of US 50 and WV 42 and by eliminating signage it would damage the businesses in Elk Garden and the Jennings Randolph Lake area as they would not be able to direct traffic to their locations.

Howell also read from the July 21st, 2004 minutes of the US 50 Association, “There are strict sign regulations such as been brought to light by the George’s Creek Coal Heritage Trail. The [Scenic Byway] Task Force recommends tabling this issue until dual lane and alternate routes can be reviewed which may leave portions of the original roadbeds to be designated as Scenic By-ways.” Scenic Byway status is anti-business.

Brian Carr stated that US 60 through most of West Virginia was a Scenic Byway and it was successful. Robert Harman reminded that Interstate 64 also paralleled US 60 for business and US 50 had no such companion.

Com. Spiggle stated he had distributed information to all the involved county commissions and he had spoken with them verbally and they were in agreement to request Byway status for US 50. Charles Baker, representing the Hampshire County Commission, objected and stated that Com. Spiggle was mistaken and that Hampshire County after reviewing all documentation felt that Byway designation may inhibit commercial development due signage regulation imposed and that their efforts to upgrade the road would be in conflict with the Scenic By designation.

Com. Spiggle then stated that the US 50 Association would not pursue the status for the full length, but that Mineral County would pursue it alone. He then invited those opposed to the Byway status to come to a Mineral County Commission meeting to voice their objections.

New Business: It was suggested that a letter be sent to Congresswoman Capito for her efforts to get ten million in funding for US 50. David Moe said it would be more appropriate to thank all of the Congressional delegation for their efforts.

It was requested that the state look at paving areas of US 50 in eastern Preston County. Both Larry Weaver and Brian Carr of WVDOH explained how the cost of asphalt was hindering the state in expanding paving projects, but they would look into the possibility.

July Meeting:

Taylor County is next on the schedule to host the July 15th, 2009 meeting a t a place to be determined.

The meeting began at 1:00 P.M. at Penn Alps Restaurant in Grantsville, MD. The Garrett County Commissioner Fred Holliday welcomed the Association to their County. Introductions were held, Represenatives from U.S. Senator Mikulski (Julianna Albowicz), Senator Cardin (Robin Summerfield), and Congresswoman Capito (Chris Strovel), and Congressman Mollohan (Cate Johnson) Offices were present. County Commission representatives from Garrett County Maryland (Fred Holliday), and Mineral (Janice LaRue and Wayne Spiggle), Hampshire (Steve Slonaker), and Preston Counties (Dave Price and Vicki Cole) in West Virginia also attended. Brian Carr from the West Virginia Division of Highways participated in the meeting. Others attending were Mona Ridder, Gary Howell from Mineral County, Charles Baker, Evelyn Baker, and Grady Bradfield from Hampshire County, Arvin Harsh from Preston County, and Liz Beavers from the Mineral News-Tribune.


A lively discussion was held on the minutes of the previous meeting, constituents from Mineral County had concerns over language and discussion of an item. It was determined through consensus that the meetings should be tapes for accuracy of minutes.


David Moe was not present at the meeting; the make-up of the Route 50 Association was discussed. A letter and brief history was read by Mrs. LaRue that clarified the original scope of the Association and it members. Documents were handed out that were drafted at the inception of the Association.


Gary Howell discussed letters that were received, one a response from Governor Manchin, and a letter concerning Corridor O Extension and a letter to promote Tier 2 Funding for U.S. 220. Cate Jonson from Congress Mollohan’s Office informed the Association of an house of Representatives Bill that was introduced, HR 1489 concerning Corridor O. On the issue of 220, Senator Byrd needs a letter to push for funding and also needs Governor Manchin’s support. Maryland also needs to help fund the project.


Brian Carr and members of the Association with knowledge of their individual counties gave a brief update on road improvements that were both under construction and proposed.


A discussion was held concerning designating Route 50 as a Scenic Byway. It was determined that Karen Ebert Allen, from the West Virginia Division of Highways, whom is in charge of Scenic Byways in the State should hold a meeting with the individual county commissions the address questions and concerns over the designations, Mr. Carr suggested holding consolidated meetings considering travel issues for Ms. Allen and similarity in questions and concerns from the commissions. It was also determined that part of Route 50 has already been designated as such and that individual sections could be designated. The individual county commissions could choose to designate the entire length or parts of the road in their county.

A short statement was given on the issues arising with Route 50 in Hampshire County. Improvements near Dunmore Ridge, Timber Ridge, Bear Garden Mountain, Grassy Lick, Mountain Top, and Cooper Mountain were given in a list. Mr. Slonaker thanked Mr. Carr for the improvements that Hampshire County did get. The three lane in Romney is in the Stimulus money at this time, South Little Cacapon Road would have to be checked in the six year stip. Mr. Carr stated the six year stip can be checked at wvdot.com. A sidenote was given that Maryland projects can be checked at www.recovery.gov.

Arvin Harsh from Preston County voiced his concern of a dangerous intersection of U.S. Route 50 and Route 24. Brian Carr stated a speed study was going to be performed in late spring or summer. Fred Holliday from Garrett County proposed the possibility of Preston County helping with the funding the improvements, much the same way they do in Maryland. A question was ask on the paving from Aurora to the Maryland line.

Preston County was determined to be the next host site for the May Meeting, at a place to be determined later.

A BRIEF HISTORY OF THE FORMATION AND ORGANIZATION OF THE

U. S. ROUTE 50 ASSOCIATION

Prepared for its March 18, 2003 meeting

  • In early October, 2003: The Hampshire County Commission convened a public meeting to discuss the need to address unsafe conditions along U.S. Rt. 50. This event was in response to a fatal accident involving a prominent Hampshire County resident. At that meeting it was suggested that more would be accomplished if a multi-county association worked on this issue. The idea of a U.S. Rt. 50 Association was brought forward. It was agreed that the county commissions would address this further.

  • On November 18, 2003 the Mineral County Commission convened a meeting of commissioners from Hampshire, Mineral, Grant and Preston Counties. A discussion paper on the formation of the Association was reviewed and amended. The commissioners asked Wayne Spiggle to act as facilitator and a follow up meeting was planned. Minutes of this meeting are available.

  • On January 30, 2004, the first official meeting of the U.S. Route 50 Association was held in the Garrett County Courthouse. Hampshire, Grant, Mineral, Garrett, Preston and Taylor County Commissions were present. Two counties sent designated representatives. Also present for the first time were WVDOH representatives, Bill Wood, Brian Carr and Marvin Murphy. The Strategic Plan and the Guidelines for Organization and Decision Making were amended and approved. Until a need for By-laws was demonstrated, these documents were to serve in that capacity. Interestingly, Scenic By-way status for Rt. 50 was discussed at this meeting.

Minutes of this meeting are available for review and the guidelines document will be reviewed in detail at this meeting to clarify the controversy that has developed over how the Association is to operate.

Dear Governor Manchin,

The US 50 Association, which also deals with regional transportation issues, at its November meeting discussed the US 220 North South Corridor with the representatives from Alan Mollohan and Shelley Capito’s office. The Tier 1 study is nearing completion and funding for their portion of the Tier 2 study has not been requested by WVDOH. Both Congressional office representatives suggested that your office formally request funding for the US 220 Tier 2 study from their congressional offices.

The US 50 Association is a participating agency with the Federal Highway Administration on the US 220 North South Corridor project that will connect Corridor H to Interstate 68. Bill Wood at the WVDOH office in Charleston has attended both the US 50 Association meetings and the US 220 North South Corridor meeting and can fill in additional information as needed.

Introductions: Steve Durst, Mayor of Bayard welcomed everyone to the meeting stating, “Without Rt. 50 they would be isolated.” Bill Ross of Grant County EDO also welcomed everyone to the Grant County meeting.

Question on the Minutes: Dave Moe asked about the following from the November 2008 minutes; “Wayne Spiggle asked if the fact the group was started by the county commissions of each county along the route could be added.” Dave Moe who attended the first meeting of the group stated it was originally set up as a citizens group. Wayne Spiggle stated it was started by the County Commissions. Mr. Moe reminded Mr. Spiggle that at the time the group as started Mr. Spiggle was not a county commissioner.

Review of Minutes: It appears the idea of bringing the County Commissions in was not offered until the 2nd Meeting of the group in March of 2004.

March 2004 Minutes - Idea to build around county commissions from Virginia state line to Harrison County.

The group invited the County Commissions to participate in the US 50 Association.

May 2004 Minutes - Memorandum of Understanding ¬ A draft memorandum of understanding was given to each county commission. The memorandum sets forth the purpose of the Association and establishes the mechanism for each commission to officially recognize and participate in its activities.

November 2004 Agenda – STATUS REPORT ON LETTERS OF UNDERSTANDING – STEVE BAKER (No Minutes for the November 2004 Meeting)

Nearly a year after the group was started the County Commissions had yet to respond to the letters of understanding. It appears from the minutes that the County Commissions were invited to be part of the group, but the group remains a citizens group. It appears that the minutes support Dave Moe’s recollections.

Old Business: The intersection of US 50 and WV 24 was discussed and the possibility of reducing the speed limit through the intersection to 40 mph from its current 55 mph. Bill Wood of WVDOH said a speed study will be done in the spring when weather will allow the installation of traffic study devices. After the study, the traffic engineering division will make a recommendation which may require a public meeting if changes are indicated.

The US 50 Brochure was not finished and 2 letters need to be sent. Gary Howell said he would finish these without additional help do to the time constraints of Mona Ridder’s job at the Economic Development Authority. Dave Moe asked to send a letter from Maryland delegation as well.

Lee Thorne of WVDOH District 5 addressed the removal of turns on US 50 where the state had already done much of the work. He stated there is no money to fix the turns. He would look at the turn west of Dorsey’s curve at the pull off area to see if it could be removed.

Dave Moe asked for a Tier 2 estimate so that the money may be requested to complete the project. He also indicated that originally the Tier 1 study was to have been completed in 18 months which would have been summer of 2007 and had yet to be completed.

Bill Woods explained that extending WV 93 was proceeding. Traffic and Engineering believes the idea has merit and will probably recommend it. The new northern terminus of WV 93 will be at the intersection of US 220 at the Blue Jay Bridge when the project is completed.

New Business:

Karen Ebert Allen of WVDOH spoke on US 50 as a scenic byway after Paul Mattox recommended it. She stated she had seen the draft of the brochure from the Association. She went on to state that the US 50 from the MD line west to Clarksburg was designated a byway and offered to set up a meeting with that group.

Dave Price stated that some byway groups oppose improving the highway to preserve the scenic qualities. He also asked about advertising being restricted along the route as a result of being made a byway. It was indicated that is the case. Mr. Price also stated he had gotten complaints from businesses unable to advertise along the scenic byway. Ms Allen stated that could be Federal restrictions and not the byway restrictions.

On a traffic light east of Romney at the entrance to the new hospital, Brian Carr stated, it will require an impact study of the new traffic pattern.

The request for center road reflectors was met with a new problem. WVDOH indicated they are not holding up well to snow plows. A new solution is centerline rumble strips. These seem to last longer. It was ask if they could look at placing these in Hampshire County along US 50 as they would help prevent sleepy drivers from crossing the centerline as many people in Hampshire County drive late and earlier hours to Winchester, VA for work.
